Women basically sue Walmart because they don't get promoted as much as men. Thank god the court told them to eat shit on that one, or every company from UPS to McDonalds would start having massive lawsuits against them. It's sad that it even got this far.

But seriously, they brought it to court because on average women don't get promoted as much as men, ridiculous.

Well, it was thrown out for the right reasons. The court basically said that this was a case by case issue and not appropriate for an entire group of people, which they are correct. In some specific cases, maybe that woman was discriminated against and not promoted. But there are still plenty of men and women who would not have been promoted, and as such, allowing all women to be part of the class was wrong, because statistically, even if you go by the men's promotion statistics, there would still have been many of them who would not have deserved the promotion to begin with, and allowing those women to be a part of the class is unfair. Thus, the only fair way to litigate the issue is on an individual basis. The court didn't say there was not a case, and in fact, that is something that has been held to be true, there is a clear case of discrimination here, but lumping every woman who worked at the company into the class of people affected is not correct or fair as only a portion were actually discriminated against, not all of them.
